  • Recruitment and resource management for IT and non-IT roles
  • Software maintenance and annual support contracts
  • Hardware supply and repair coordination

The specific services provided to a client will be defined in the applicable quotation, proposal, work order, statement of work, service agreement, or other written communication.

2. Website Usage

You may use our website for lawful purposes only.

You agree not to:

  • Use the website for any unlawful purpose

  • Maintenance and support

The exact scope, timeline, pricing, deliverables, and responsibilities will be specified in the applicable quotation or project agreement.

4. Database and Infrastructure Support Services

Database, network, server and desktop support services are provided according to the support plan, annual maintenance contract, or service agreement accepted by the client.

The applicable plan may define:

  • Covered databases, servers and environments
  • Support hours and response times
  • Scope of routine and emergency activities
  • Backup, monitoring and patching responsibilities
  • Escalation procedure
  • Activities treated as additional chargeable work

Support requires the client to provide timely access to the relevant systems, credentials, and vendor support accounts. Where access is provided by the client, the client remains responsible for authorising that access and for revoking it when the engagement ends.

5. Training Services

Corporate and in-house training is delivered according to the curriculum, batch size, schedule, venue and fees agreed in writing before the programme begins.

Unless otherwise agreed:

  • Training fees are payable before the programme starts
  • Rescheduling requires reasonable advance notice
  • Training material provided by Bramha Tech is for the participant's own use and may not be redistributed or resold
  • The client is responsible for the training venue, hardware and network access for on-site programmes

6. Recruitment and Resource Management

Where Bramha Tech provides recruitment or resource management services, the applicable agreement will define the role, engagement type, fees, replacement terms and notice period.

The client is responsible for:

  • Final selection of any candidate
  • Conducting its own verification where required
  • Day-to-day supervision of deployed resources
  • Compliance with applicable employment and labour laws

Bramha Tech presents candidates based on the information available to it and does not guarantee the future performance or continued availability of any individual.

7. Project Requirements and Scope

The client is responsible for providing accurate and complete requirements, content, documents, credentials, access, approvals, and other information reasonably required to complete the project.

Changes to approved requirements may result in:

  • Additional development time
  • Additional charges
  • Changes to the delivery schedule
  • Changes to project scope

Any significant change in requirements may be treated as additional work and may require separate approval or quotation.

8. Project Timeline

Project timelines are estimates based on the requirements and information available at the time of estimation.

Delays may occur due to:

  • Changes in requirements
  • Delayed client approvals
  • Delayed content or data
  • Third-party API or service issues
  • Payment delays
  • Hosting or infrastructure issues
  • Technical dependencies
  • Force majeure events

Bramha Tech will make reasonable efforts to complete projects within the agreed timeline.

9. Client Responsibilities

The client agrees to:

  • Provide accurate requirements
  • Provide required content and data
  • Provide timely approvals and feedback
  • Provide required third-party accounts or access
  • Ensure that supplied content is legally permitted to be used
  • Make payments according to the agreed payment schedule
  • Review and approve deliverables within a reasonable period

Bramha Tech shall not be responsible for delays caused by information, approvals, access, or dependencies controlled by the client.

10. Pricing and Payments

Project pricing will be communicated through a quotation, proposal, invoice, work order, or service agreement.

Unless otherwise agreed:

  • Payments must be made according to the agreed payment schedule.
  • Taxes, including applicable GST, may be charged separately where applicable.
  • Third-party charges may be billed separately.
  • Additional requirements may incur additional charges.
  • Delayed payments may result in suspension of development or support services.

Examples of third-party charges may include:

  • Domain registration
  • Web hosting
  • Cloud services
  • Database and software licences
  • SMS services
  • WhatsApp services
  • Payment gateway charges
  • Email services
  • Map and API services
  • App store fees
  • Other external services

11. Intellectual Property

Unless otherwise agreed in writing, Bramha Tech retains ownership of its:

  • Pre-existing software
  • Frameworks
  • Libraries
  • Reusable components
  • Development tools
  • Templates
  • Internal systems
  • Generic code components
  • Scripts, runbooks and technical methodologies
  • Training material and know-how

Ownership or licensing of custom-developed project deliverables will be governed by the applicable client agreement, quotation, or written contract.

Third-party software, open-source libraries, APIs, fonts, plugins, and other third-party components remain subject to their respective licences and terms.

12. Client Content and Data

The client remains responsible for the legality, accuracy, ownership, and authorised use of content and data supplied to Bramha Tech.

The client must ensure that it has the necessary rights, permissions, licences, and consents to provide such information to Bramha Tech for project purposes.

Bramha Tech will not knowingly use client data for purposes outside the agreed scope, except where required by law or necessary to provide the contracted service.

13. Confidentiality

Both parties may receive confidential business, technical, financial, operational, or other information during a project.

Each party agrees to take reasonable steps to protect confidential information and not disclose it to unauthorised third parties except:

  • With the other party's permission
  • To authorised employees or service providers who need the information
  • Where required by law
  • Where the information has become publicly available through no fault of the receiving party

Additional confidentiality obligations may be established through a separate non-disclosure agreement.

14. Hosting and Third-Party Services

Where Bramha Tech provides hosting, domain, cloud, email, API, payment gateway, or other third-party services, such services may be subject to the terms and policies of the respective service providers.

Bramha Tech cannot guarantee uninterrupted availability of third-party services.

Third-party outages, policy changes, API changes, service termination, pricing changes, or infrastructure problems may affect the availability or functionality of an application.

15. Software Maintenance and Support

Maintenance and support services, where applicable, will be provided according to the selected support or annual maintenance contract.

Support plans may define:

  • Support hours
  • Response times
  • Bug-fix scope
  • Maintenance activities
  • Server monitoring
  • Backup services
  • Security updates
  • Feature enhancement limitations

New functionality or major changes may be treated as additional development work.

16. Warranty and Bug Fixes

Bramha Tech will make reasonable efforts to correct reproducible software defects that fall within the agreed project scope.

A bug does not generally include:

  • New functionality requests
  • Changes in business requirements
  • Changes to third-party APIs
  • Problems caused by unauthorised modifications
  • Problems caused by third-party hosting or infrastructure
  • Problems caused by incorrect client data
  • Problems caused by unsupported software or environments

Any warranty or post-delivery support period will be as specified in the applicable quotation or agreement.

17. Availability and Service Interruptions

We aim to provide reliable services but do not guarantee that our website, applications, servers, or services will always be available without interruption.

Services may temporarily become unavailable due to:

  • Scheduled maintenance
  • Emergency maintenance
  • Hosting problems
  • Network failures
  • Security incidents
  • Third-party service interruptions
  • Natural disasters
  • Government actions
  • Other circumstances beyond our reasonable control

18. Data Backup

Where the client is responsible for hosting or data management, the client should maintain appropriate backups of its information.

Where backup services are specifically included in a Bramha Tech service agreement, backups will be performed according to the agreed backup policy.

Bramha Tech cannot guarantee recovery of every item of data in every circumstance.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Bramha Tech shall not be liable for indirect, incidental, special, consequential, or business losses arising from the use or inability to use our website, software, or services.

This may include loss of:

  • Profits
  • Revenue
  • Business opportunities
  • Data
  • Goodwill
  • Expected savings

Where a specific project agreement contains a different limitation of liability, that agreement will govern the relevant project.

Nothing in these Terms & Conditions is intended to exclude liability that cannot legally be excluded or limited under applicable law.

20. Third-Party Content and Links

Our website may contain links to third-party websites or services.

Such links are provided for convenience and do not imply that Bramha Tech endorses or controls those websites.

We are not responsible for third-party content, availability, security, privacy practices, or services.

21. Testimonials and Portfolio

Where permitted by the applicable client agreement, Bramha Tech may display project names, screenshots, logos, descriptions, or testimonials in its portfolio, website, presentations, or marketing material.

If a project is subject to confidentiality restrictions, Bramha Tech will respect those restrictions.

22. Suspension or Termination

Bramha Tech may suspend or terminate access to a service where:

  • Payments remain overdue
  • The service is being misused
  • There is unauthorised access or activity
  • The client breaches applicable terms
  • Continuing the service would create a legal or security risk

Termination of a service does not automatically eliminate payment obligations that have already become due.

Project-specific termination and refund provisions will be governed by the applicable agreement or quotation.

23. Force Majeure

Bramha Tech shall not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, war, civil disturbances, government actions, internet or telecommunications failures, major infrastructure failures, cyber incidents, labour disruptions, or failures of third-party service providers.

24. Changes to These Terms

Bramha Tech may update these Terms & Conditions from time to time.

Updated terms will be published on this website with a revised "Last Updated" date.

Your continued use of the website or applicable services after an update may constitute acceptance of the revised terms, subject to applicable law and any separate contractual agreement.

25. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by the laws applicable in India.

Subject to applicable law and any specific agreement between Bramha Tech and a client, disputes arising from these Terms & Conditions shall be subject to the jurisdiction of the competent courts having jurisdiction over Pune, Maharashtra, India.
